The agonising moments leading up to Kirsty Maxwell's tragic plunge from a ten-storey Benidorm tower block described in a Spanish police report can today be revealed by MailOnline.

The 27-year-old is thought to have clambered over a balcony and fallen to her death when she walked into the wrong apartment after a night out on the town.

One of the men in the apartment told police he heard a friend shout: 'There's a girl in the bathroom' and 'Leave this room' before adding a few moments later: 'F***, she has jumped.'

Mrs Maxwell - still wearing her pink hen t-shirt - was subsequently found next the apartment block's swimming pool, with a white bracelet saying 'bridesmaid' lying close by.

A lawyer for the Maxwell family has claimed the hen party reveller was in a 'state of terror ' and felt she had no choice but to jump after she had drunkenly entered the flat.

Luis Miguel Zumaquero compared her situation to that of a person trapped in a burning building with no choice but to leap into the 'abyss'.

He used the report to relay to the judge the police's own conclusions that Mrs Maxwell panicked after finding herself in an apartment with five male strangers inside.

The report details the investigations carried out by police into drug-taking in the apartment.

According to the report, police only found out that Mr Graham had taken cocaine when they took him hospital after noticing he had suffered a nose bleed.

Detectives thought he might have sustained the nosebleed during a struggle with Mrs Maxwell.

But on examination a doctor discovered his nasal cavities were 'red raw' because of the 'large amount' of cocaine he had consumed before Mrs Maxwell walked in.



A forensic team found a Marlborough Gold cigarette like the ones smoked by Graham on the floor next to the sliding door leading to the Juliet balcony where she fell.

Mr Graham's defence lawyer Roberto Sanchez told Mail Online: 'No-one is disputing the fact Joseph Graham took cocaine or had been drinking before Kirsty Maxwell walked into that apartment.

'The fact a cigarette of the type he smokes was by the balcony she went over doesn't incriminate him in any way.

'He could have been about to smoke it by the window when she walked through the door unexpectedly.'

The report revealed Mr Graham, a £49,000 a year worker with Amazon, opened the door to Mrs Maxwell who had walked up a flight of stairs from her flat below. Police believe she was looking for her friends sleeping on the 10th floor.

The report, written in Spanish but translated by Mail Online, says: 'We believe she left her apartment 9A dressed but barefoot with the intention of entering the apartment of a female friend to ask her for medicine because she felt unwell, or simply to see one of her female friends.'
